Spirits Label Compliance: A Three-Layer Market-by-Market Approach

How to verify label compliance before entering a new market — EU legislation, national requirements, and retail standards in one practical framework.

Labelling errors are among the most common reasons for product rejection at customs inspection or when attempting to place a product on a retailer's shelf. The Reserve has compiled a practical framework to help producers and importers verify label compliance before entering a new market.

Layer 1 — EU legislation (baseline)

Regulation (EC) No 110/2008 and its 2021 amendment set minimum requirements for all spirits sold in the EU:

  • Legal category (e.g. "Whisky", "Gin", "Vodka") per Annex II
  • Alcoholic strength in %vol to ±0.3% accuracy
  • Net volume
  • Sulphite warning (if ≥ 10 mg/l SO₂)
  • Lot code (under Directive 2011/91/EU)

Layer 2 — National requirements

Each country can add its own requirements above the EU baseline:

  • SK/CZ: Label language must be Slovak/Czech, or a Slovak/Czech label must be attached
  • DE: Specific rules for regional designations and Qualitätswein
  • AT: Mandatory registration for certain alcoholic beverages
  • PL: Mandatory health warning text on labels

Layer 3 — Retail requirements

Retailers and distributors may have their own additional requirements:

  • Minimum font size and contrast requirements
  • Nutritional information (prospectively mandatory in the EU)
  • EAN/GS1 barcode
  • Language versions specific to a particular chain

Quick checklist (5 minutes)

  1. ☐ Legal category matches the definition in Annex II of Regulation 110/2008
  2. ☐ ABV stated with ±0.3% accuracy and correct "%vol" format
  3. ☐ Sulphite warning present (if ≥ 10 mg/l SO₂)
  4. ☐ Lot code present
  5. ☐ Language version matches the target country
  6. ☐ Volume corresponds to legal pack sizes for the target market
